Humanitarian Residence Permit in Turkey: Who Can Obtain It and How to Apply?
The humanitarian residence permit under Article 46 of Law No. 6458 is an exceptional protection status for foreigners who do not qualify for other permit types but whose presence in Turkey is considered humanitarily necessary.
Who Can Apply?
- Foreigners who cannot be returned to their country (political persecution, war, refusal to readmit)
- Those who would face torture, severe ill-treatment or death if deported
- Those who applied for asylum but did not obtain international protection status
Rights Granted
- Legal residency status (cannot be deported)
- Right to renewal while conditions persist
- Access to education and healthcare
If Refused
File an administrative objection within 30 days or an annulment lawsuit within 60 days. A stay of execution request is critical where serious danger is at stake.
